What Is Mediation?

Mediation is a process that parties in a lawsuit go through to attempt to agree to a solution before going to trial and having a judge or jury decide the case.  During this process, a mediator such as Nancy or Donna does not represent either party.  Instead, they work to facilitate an agreement as a neutral third party.

As mediators, Nancy and Donna both believe that resolution can be achieved by helping each side understand the financial, personal and business ramifications of the dispute — and what a settlement would mean for them.  Their decades of experience have served them well in helping parties reach settlements.

Nancy served as a District Court Judge for eight years, overseeing dozens of jury and bench trials in Mecklenburg County.  With her extensive courtroom experience, Nancy knows how the litigation process works — and how juries reach verdicts in cases.  This gives her unique insight into the risks of going to trial and helps her move parties toward a settlement through mediation. Nancy has been certified as a mediator by the Superior Court since 1997 and has also participated in a mediation as a party herself.  This first-hand experience helps her to understand what the parties in a mediation go through as they struggle to resolve a legal issue.
